These Terms of Service (“Terms”) govern your access to and use of the Virtual Private Server (VPS) hosting services provided by Tranquila-Host Ltd. (“Company”, “we”, “us”, or “our”), a company operating under the jurisdiction of the United Kingdom, via our website (the “Website”).

By registering an account and using our services, you (“User”, “Customer”) agree to be bound by these Terms. By using our services, you confirm that you are at least 18 years of age and possess the legal capacity to enter into binding contracts under applicable law.

1. Description of Service

Tranquila-Host Ltd. provides strictly Virtual Private Server (VPS) hosting services. We do not provide shared web hosting or dedicated bare-metal servers.

Scope of Support: Unless a separate, specific agreement is in place, our services are provided on a strictly “unmanaged” basis. Our primary responsibility is to ensure the availability of the base infrastructure. The setup, operation, maintenance, and software configuration inside the server remain outside our general scope of responsibility and are managed by the Customer.

2. Service Level Agreement (SLA) & Data Security

Uptime Guarantee: We guarantee a 99% network and server availability SLA. If we fail to meet this SLA, you are entitled to compensation credited to your internal account balance.

Data Responsibility: All data on our physical nodes is stored using RAID arrays for hardware redundancy. However, the Customer is solely responsible for the integrity and preservation of their data. We highly recommend that you maintain your own regular off-site backups. We are not responsible for any data loss.

Fair Use of Resources: While your VPS is allocated specific resources, the underlying infrastructure is shared. We reserve the right to apply temporary or permanent limitations, traffic shaping, or restrictions to your CPU, disk subsystem, or network uplinks if your usage patterns are deemed disproportionate, excessive, or potentially disruptive to the overall performance of our systems.

3. Billing, Payments, and Refunds

Pricing Model: Services can be billed on an hourly, monthly, or yearly basis, depending on your selected plan.

Internal Balance: All payments for active services are deducted automatically from your internal account balance.

Refund Policy: You have the right to request a refund for any unused funds currently available on your internal account balance at any time. This includes cases where an account or service was suspended or terminated due to a violation of these Terms. We do not apply any administrative fees or penalties for processing refunds. For payments made via cryptocurrency, refunds are fully supported and will be calculated and processed based on the exact fiat equivalent in Euros (EUR) that was credited to your account at the time of the initial transaction.

Non-Payment & Suspension: If your internal balance is insufficient to cover the cost of your active services, your VPS will be temporarily suspended. You will have a grace period of up to 7 days to add funds to your balance. If the balance is not replenished within this period, the server and all associated data will be permanently deleted.

4. Acceptable Use Policy (AUP)

You agree to use our services for lawful purposes only. The following activities and content are strictly prohibited on our network:

  • Spamming or sending unsolicited bulk emails.
  • Phishing or hosting fraudulent websites.
  • Cryptocurrency mining.
  • Hosting, distributing, or using DDoS scripts and tools.
  • Port scanning or unauthorized network probing.
  • Hosting or distributing pirated content or violating intellectual property rights.
  • Hosting, distributing, or executing malware, viruses, or any malicious software.

VPN and Proxy Policy: You are allowed to install and run VPN or Proxy servers strictly for personal use. The operation of public or commercial VPN/Proxy services is strictly prohibited. Because operators of such services cannot monitor or guarantee the legality of the traffic generated by their end-users, we do not permit them on our infrastructure.

5. Abuse Policy & Enforcement

We take abuse reports seriously and investigate all claims.

Resolution Time: If an abuse complaint is filed against your server, we will notify you and provide you with a reasonable amount of time to resolve the issue.

Immediate Suspension: We do not issue immediate bans by default; however, in severe cases (e.g., active distribution of malware, severe outgoing attacks), we reserve the right to suspend the server immediately to protect our network.

IP Address Reputation: Customers are strictly responsible for maintaining the clean reputation of their assigned IP addresses. Should an IP address become degraded, blacklisted, or otherwise negatively affected as a result of your activities, we reserve the right to temporarily or permanently suspend the associated service.

6. User Accounts & Refusal of Service

No KYC: We respect your privacy. Identity verification (KYC/passport requests) is not required for registration, nor do we request it in the event of suspicious account activity.

Account Security: You bear full and sole responsibility for all activities that occur under your account and for maintaining the absolute confidentiality of your credentials (including passwords and API keys). We are not liable for any data loss, service disruption, or financial damage arising from unauthorized access or compromised account security on your end.

Refusal of Service: We reserve the right to refuse service or terminate an account. In the event that we refuse to provide you with our services, we will provide you with a clear explanation of the reason.

7. Limitation of Liability and Disclaimers

“As Is” Provision: All services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

Limitation of Liability: To the maximum extent permitted by applicable law, Tranquila-Host Ltd. shall not be liable for any direct, indirect, incidental, special, or consequential damages. We bear no financial responsibility for any loss of profits, loss of business, lost revenue, or loss of data resulting from the use or inability to use our services, even if we have been advised of the possibility of such damages.

8. Governing Law

These Terms and any disputes arising out of or related to our services shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

9. Modifications to the Terms

We reserve the right to modify these Terms as our business and services evolve. In the event of any changes, we commit to notifying our users. Upon such updates, you will be prompted to review and explicitly re-accept the revised Terms in order to continue using our services.
